These Terms of Use (“Terms”) govern access to the website available at endorsium.org (the “Website”), operated by Endorsium Association, a non-profit association established under Swiss law, with its registered office at Route des Acacias 48, 1227 Carouge, Geneva, Switzerland (“Endorsium Association”, “we”, “us” or “our”).

By accessing the Website, you agree to these Terms.

1. Purpose of the Website

The Website is the official informational website of the Endorsium Association.

It provides information about the Endorsium Protocol, its development and its ecosystem, and may provide access to publications, documentation and links to third-party websites, applications and services.

The Website is provided for informational and educational purposes only.

The Website is distinct from the Endorsium Protocol itself and from applications, platforms and services that interact with or implement the Endorsium Protocol. Accessing the Website does not, by itself, constitute an interaction with the Endorsium Protocol or any blockchain.

2. Information on the Website

We seek to keep the information published on the Website accurate and up to date. However, the Endorsium Protocol and its ecosystem may evolve over time.

We do not guarantee that all information available on the Website is at all times complete, accurate or current.

We may modify, update, remove or suspend any part of the Website without prior notice.

Information concerning the Endorsium Protocol, EDRSM, GRAM or other digital assets is provided solely for informational purposes and does not constitute financial, investment, legal or tax advice.

Nothing on the Website constitutes a guarantee or representation as to the present or future financial value of any digital asset.

3. Authorized Partners

The Website may identify certain independent persons or entities as “Authorized Partners” of the Endorsium ecosystem.

An Authorized Partner is a person or entity that has been authorized or recognized by the Endorsium Association to perform or participate in the specific ecosystem activity indicated on the Website.

Unless expressly stated otherwise, Authorized Partners are independent from the Endorsium Association. They operate under their own responsibility and may provide their services subject to their own terms, privacy policies and applicable legal or regulatory requirements.

Authorized Partner status does not make an Authorized Partner an employee, agent, representative, subsidiary or legal affiliate of the Endorsium Association and does not authorize it to bind the Endorsium Association.

Authorization relates only to the activity or capacity for which it has been granted. The Endorsium Association may modify, suspend or withdraw an Authorized Partner’s status in accordance with the applicable ecosystem rules or arrangements.

Users should review the terms and policies applicable to an Authorized Partner before using its services.

4. Third-Party Websites and Services

The Website may contain links to websites, applications and services operated by third parties, including Authorized Partners and other participants in or services related to the Endorsium ecosystem.

When you follow such a link, you leave the Website and interact with a service operated independently from endorsium.org.

Except for the specific status expressly attributed to an Authorized Partner under Section 3, the presence of a link on the Website does not imply that the Endorsium Association operates, controls, guarantees or assumes responsibility for the relevant third-party service.

The Endorsium Association is not responsible for the availability, content, security, transactions, terms or practices of independent third-party services.

This is consistent with the basic approach taken by TON Foundation, whose Terms expressly distinguish its informational website from the underlying network and separately address third-party services. 

5. Intellectual Property

Unless otherwise indicated, the Website and its original content, design, trademarks, logos and other materials are owned by or licensed to the Endorsium Association and are protected by applicable intellectual property laws.

Certain materials relating to the Endorsium Protocol, including software, documentation or technical specifications, may be made available under separate licences. Where a separate licence applies, that licence governs the relevant material.

No use of the Endorsium name, trademarks or logos is permitted in a manner that falsely suggests authorization, partnership or endorsement by the Endorsium Association.

6. Disclaimer and Liability

The Website is provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, the Endorsium Association makes no warranty regarding the availability, accuracy, completeness or reliability of the Website or its contents.

The Endorsium Association shall not be liable for losses or damages arising from the use or inability to use the Website, reliance on information published on it, or the use of independent third-party websites, applications or services accessed through links on the Website, except where liability cannot lawfully be excluded or limited.

7. Privacy

Personal data processed in connection with the Website is handled as described in our Privacy Policy.

8. Changes to these Terms

We may update these Terms from time to time. The version published on the Website at the time of your visit applies to your use of the Website.

9. Governing Law

These Terms are governed by Swiss law. Subject to any mandatory provisions of applicable law, disputes relating to the Website or these Terms shall be subject to the jurisdiction of the competent courts of Geneva Canton, Switzerland.
